Terms of Service
Effective: 2026-05-04.
1. Acceptance
By accessing or using SocialCard ("the Service"), operated by Kenichi Ebine ("we", "us"), you agree to these terms. If you do not agree, do not use the Service.
2. Account & Authentication
You authenticate via Clerk (email or supported OAuth providers). You are responsible for keeping your credentials and API keys secret. We are not liable for losses caused by unauthorized use of your account or API keys.
3. Service Description
SocialCard returns rendered PNG images via HTTP requests. Images are generated at the edge and cached. Monthly request quotas apply per plan. Free-plan responses include a watermark.
4. Pricing & Billing
Subscription fees are charged in advance, on a monthly cycle, via Stripe. Plans and quotas are described on the pricing page. Plan changes take effect immediately; unused quota does not roll over.
5. Cancellation & Refunds
You may cancel your subscription anytime from your dashboard. Cancellation takes effect at the end of the current billing period; the Service remains available until then. As a digital subscription, fees already paid are non-refundable.
6. Acceptable Use
You agree not to:
- Use the Service to render unlawful, defamatory, or infringing content.
- Attempt to circumvent quotas, rate limits, or watermarks.
- Resell raw API access without our written permission.
- Use the Service to attack, probe, or interfere with other systems.
7. Content Ownership
You retain ownership of the content you submit (titles, copy, colors). You grant us a worldwide, royalty-free license to render, cache, and serve that content for the purpose of operating the Service. We do not claim ownership of generated images beyond the underlying template designs.
8. Service Availability
The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted operation. Scheduled maintenance, infrastructure failures (Cloudflare, Supabase, Stripe, Clerk), or upstream issues may temporarily affect availability.
9. Limitation of Liability
To the maximum extent permitted by applicable law, our total liability arising from or related to the Service is limited to the fees you paid us in the three months preceding the claim. We are not liable for indirect, consequential, or incidental damages.
10. Termination
We may suspend or terminate accounts that violate these terms or exceed plan quotas repeatedly after warning. You may terminate by canceling your subscription and deleting your account.
11. Changes to These Terms
We may update these terms. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
12. Governing Law
These terms are governed by the laws of Japan. Disputes are subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
